Hank's Appliance Repair Service: Terms of Service
 

This is a legally binding agreement. By authorizing Hank's Appliance Repair Service (referred to as "Technician" or "Company") to commence service, the Customer agrees to all terms and conditions outlined below.

 

I. Minnesota State Compliance & Estimates
 

 

1. Authorization and Right to Repair
 

The Customer authorizes the Technician to perform the necessary diagnostic and repair services on the appliance(s) specified on the work order.

 

2. Written Estimate Requirement (MN Statute § 325F.58)
 

Written Estimate: Upon the Customer's request, and prior to the commencement of repairs, the Technician will provide a written estimate for any repairs expected to cost more than $100.00.
Price Limitation: The final charged price for repairs will not exceed 110% of the total price stated in the written estimate without the Customer's prior oral or written authorization.
Estimate Charge: A separate charge for the diagnostic fee (estimate fee) or service call will be disclosed to the Customer and will be in addition to the estimated price for repairs. This fee is due regardless of whether the Customer elects to proceed with the repair.
 

3. Invoice (MN Statute § 325F.60)
 

Upon completion of repairs, the Technician will provide the Customer with a dated invoice containing: a description of all repairs performed; an itemization of charges for parts, labor, tax, and other fees; and a notation specifying which parts, if any, are new, used, rebuilt, reconditioned, or replated.

 

4. Return of Replaced Parts (MN Statute § 325F.62)
 

If requested before repairs are commenced, the Technician will return all replaced parts to the Customer, except for parts required to be returned to the manufacturer under a warranty or exchange program.

 
 

II. Warranty and Limitation of Liability
 

 

5. Limited Warranty
 

The Company warrants that the parts supplied and the repair service provided will be free from defects in materials and workmanship for a period of 90 Days from the date of service, unless otherwise specified in writing. This warranty applies only to the specific part(s) replaced and the labor directly associated with that specific repair.

Exclusions: This warranty does not cover problems arising from: subsequent misuse, unauthorized repair attempts, power surges, plumbing or electrical failure unrelated to the repair, or failure of a different component on the same appliance.
Manufacturer Warranty: The Company makes no warranty on any new appliance or manufacturer's parts; such warranties are the sole responsibility of the manufacturer.
 

6. WAIVER AND LIMITATION OF LIABILITY (Critical)
 

The Customer understands and agrees that appliance repair carries inherent risks of incidental damage, particularly with older appliances, cabinetry, or flooring.

The Company's liability for any damage to person or property (including property damage, personal injury, and loss of spoiled food or other valuables) shall be limited to the cost of the repair service paid by the Customer, or the cost of repairing the damaged item, whichever is less.
EXCLUSION OF GREATER THAN ORDINARY NEGLIGENCE: Pursuant to MN Statute § 604.055, this limitation of liability and waiver is valid for ordinary negligence only. The Company does not and cannot waive liability for damage, injuries, or death resulting from conduct that constitutes greater than ordinary negligence (e.g., gross negligence, willful misconduct).
Consequential Damages Waiver: The Company shall not be liable for any indirect, special, incidental, or consequential damages (such as loss of use, lost profits, or lost property) resulting from the service.
 

7. Property Access and Condition
 

The Customer warrants that the premises where service is to be performed are safe and that the Technician has reasonable access to the appliance. The Customer is responsible for clearing the workspace of personal property, valuables, or fragile items. The Company is not responsible for damage to flooring, cabinetry, countertops, walls, or surrounding property that occurs when the appliance must be moved for diagnosis or repair, unless caused by the Technician's gross negligence.

 
 

III. Payment and Dispute Resolution
 

 

8. Payment Terms
 

Payment in full is due immediately upon completion of service, unless otherwise specified in writing. The Company reserves the right to charge a late fee of 3% per month on all overdue balances past 30 days.

 

9. Parts and Returns
 

Special order, electronic, or custom-ordered parts require a 50% non-refundable deposit and cannot be returned once ordered. The Company will provide a refund for unused, non-special-order parts returned within 30 days of the original service date.

 

10. Dispute Resolution and Governing Law
 

Any dispute arising under this Agreement shall be governed by the laws of the State of Minnesota. Any legal action or proceeding related to this Agreement shall be brought exclusively in the courts of Washington County, Minnesota. Both parties agree to first attempt to resolve any dispute through good-faith negotiation or non-binding mediation before pursuing litigation.

 

11. Severability
 

If any provision of these Terms is found to be outdated, invalid, or unenforceable by a Minnesota court of competent jurisdiction, that provision will be severed, and the remainder of the Terms will remain in full force and effect.
